Here is the letter that was sent to the Suffolk County Dept of Health Services from the attorney for Housing Help.<br />
We especially like the last paragraph, where it basically threatens the County with a discrimination lawsuit if the variance is not granted.<br />

			<content:encoded><![CDATA[<p>The Suffolk County Department of Health Review Board is expected to announce its decision on a variance request submitted by developers of the proposed Matinecock Court Housing Development in March, according to DOH spokesperson Grace Kelly-McGovern.</p>
<p>Public correspondence has flooded the DOH since the last variance hearing on Nov. 17 for relief of minimum separation distance requirements of a proposed on-site sewage treatment plant. Housing Help, the nonprofit affordable housing agency behind Matinecock Court, is now reviewing the correspondence and preparing a response which will be read at a public hearing likely to be scheduled for March 15. The DOH will subsequently announce its official decision.<br />

			<content:encoded><![CDATA[<p>The proposed Matinecock Court development will generate 155 multi-family housing units on a 14.5 acre parcel in East Northport that is currently undeveloped open space. This development equates to approximately 10.6 units per acre. The Town of Huntington Planning Board issued a Positive Declaration back in 1995 for the proposed development. When a planning board issues such declaration it automatically triggers the necessity of preparing an Environmental Impact Statement as per New York State SEQRA law otherwise known as the (State Environmental Quality Review Act). In basic terms, the SEQRA process requires the Applicant, in this case Housing Help, Inc, to explore all potential adverse environmental impacts and mitigating measures, if any, to offset such impacts.</p>

			<content:encoded><![CDATA[<p>The purpose of this petition is quite simple.  All we are asking is that Suffolk County Department of Health Services-Board of Review, enforce the MINIMUM setback requirements developed by them to ensure public safety.  We implore you to adhere to the 150 foot minimum setback requirement between the STP and the LIPA sub-station, as well as the 200 foot minimum set back requirement between the STP and the other buildings or structures.  We are also extremely concerned about a precedent being set if this variance is granted.  The future requests for the same concessions will be expected from every real estate developer.  We implore you to do your duty and enforce the MINIMUM setback requirements developed by your very organization,  to ensure public safety to everyone in our community.

The Huntington Town Planning Board approved the 155-unit, half rental, half ownership site plan at Pulaski and Elwood roads in January 2010 after years of <a href="http://www.fairhousing.com/index.cfm?method=page.display&amp;pagename=advocate_october02_page2">delays</a> and <a href="http://www.stopmc.com/">community opposition</a>. Now, the developers will seek Suffolk County&#8217;s approval for an on-site sewage treatment plant, a process which could take months as the review board compiles written testimony from the public.</p>
<p>Developers will need a county variance for the location of the treatment facility because of its proximity to surrounding structures such as the railroad track, a LIPA substation, and the proposed housing development itself. Opponents also cite the plant&#8217;s proximity to the <a href="http://northport.patch.com/listings/pulaski-road-elementary-school">Pulaski Road School</a> and <a href="http://northport.patch.com/listings/northport-high-school">Northport High School</a> as a point of concern.</p>
